This book analyses how protecting the rights of local communities can contribute to the alleviation of ecological harms through the development of an innovative 'Rights for Ecosystem Services' framework. Ecosystem Services describe the range of social, ecological, and economic benefits that people obtain from nature. Recognising the role of local communities in the maintenance of these services - through, for example, practices of natural resource management - is vital to their sustainability. This book draws on arguments for the rights of nature to transform the current Payments for Ecosystem Services framework into a unique Rights for Ecosystem Services framework. With reference to a case study from Sicily, the book develops such a framework as a crucial means through which the environmental role of local communities can be recognised, protected and fostered. Employing insights from a range of disciplines, this book will appeal to scholars working in the areas of environmental law, legal theory, political philosophy, human rights and environmental studies; as well as others with practical concerns in the fields of conservation science and natural resource management.

This timely book brings to the foreground the considerable tensions between the need to engage the public in the importance of environmental governance and the need of professional expertise to address the issues which arise. In doing so, it highlights that not only can public opinion deviate from scientific knowledge, but scientific knowledge itself can be lacunose or contradicting. Drawing together insights from some of the leading scholars, this engaging work will provide guidance to decision makers, including judges, on how to govern public participation procedures and professional expertise and the role that the precautionary principle can play in this regard.

Master's Thesis from the year 2011 in the subject Politics - Topic: Development Politics, grade: A (18/20), Great Distinction, Humboldt-University of Berlin (Ghent University (Belgium), Agrocampus Ouest (France), Humboldt University of Berlin (Germany)), course: International Master of Science in Rural Development, language: English, abstract: Policy instruments based on Payments for Environmental Services (PES) have been increasingly applied by different actors responsible for water resources and environmental conservation in Brazil. This thesis analyses farmer's decision to participate or refuse participation these schemes, focusing not only on farm or farmers characteristics, but also on the process of project implementation. The methodological structure consisted of a qualitative analysis under the perspective of institutional economics and a logistic regression model of revealed preferences. This structure applied to scrutinize three different PSE-water projects in Brazil: Conservadores das Águas (Extrema - MG), Oásis (Apucarana - PR) and ProdutorES (Espírito Santo State), selected accordingly to five main criteria: i) active projects, ii) active participation; iii) different governance models; iv) different farming regions; and v) similar ecological objectives. Database consisted of 24 semi-structured interviews conducted with local environmental managers, and a survey applied to 163 participants and non-participant farmers. Results indicate five main conclusions: 1) The non-recognition of the interactions between riparian vegetation and water flow regulation undermines efforts to engage farmers proactively in PES projects, reduces trust-building processes and might act as a conflict generation factor in the medium term; 2) The participation of a legitimate and representative organisation of farmers' interests during all phases of project development and execution significantly reduces transaction costs associated with farmers' engagement and subsequent

Rights Of Nature written by Daniel P. Corrigan and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-05-16 with Law categories.

Rights of nature is an idea that has come of age. In recent years, a diverse range of countries and jurisdictions have adopted these norms, which involve granting legal rights to nature or natural objects, such as rivers, forests, or ecosystems. This book critically examines the idea of natural objects as right-holders and analyzes legal cases, policies, and philosophical issues relating to this development. Drawing on contributions from a range of experts in the field, Rights of Nature: A Re-examination investigates the potential for this innovative idea to revolutionize the concepts of rights, standing, and recognition as traditionally understood in many legal systems. Taking as its starting point Stone’s influential 1972 article "Should Trees Have Standing?," the book examines the progress rights of nature have made since that time, by identifying central themes, unifying principles, and key distinctions in how rights of nature discourse has been operationalized in the disciplines of law, philosophy, and the social sciences. These themes and principles are illustrated through a wide variety of examples, including ecosystem services, indigenous thinking, and ecological restoration, demonstrating how the relationship between humanity and the natural world may be transforming. Taking a philosophical, political, and legal perspective, this book will be of great interest to students and scholars of environmental law and policy, environmental ethics, and philosophy.
