Questions of gender have strongly influenced the development of international refugee law over the last few decades. This volume assesses the progress toward appropriate recognition of gender-related persecution in refugee law. It documents the advances made following intense advocacy around the world in the 1990s, and evaluates the extent to which gender has been successfully integrated into refugee law. Evaluating the research and advocacy agendas for gender in refugee law ten years beyond the 2002 UNHCR Gender Guidelines, the book investigates the current status of gender in refugee law. It examines gender-related persecution claims of both women and men, including those based on sexual orientation and gender identity, and explores how the development of an anti-refugee agenda in many Western states exponentially increases vulnerability for refugees making gendered claims. The volume includes contributions from scholars and members of the advocacy community that allow the book to examine conceptual and doctrinal themes arising at the intersection of gender and refugee law, and specific case studies across major Western refugee-receiving nations. The book will be of great interest and value to researchers and students of asylum and immigration law, international politics, and gender studies.

This is the first comprehensive socio-legal study of the interrelation between gender and the law of refugee status. In the past decade, the issue has received increasing attention in academic writing, the media and the courtroom. This book contains an interdisciplinary analysis. The empirical data, collected for this study and not published previously, concerns Dutch asylum practice. The Netherlands is a prominent refugee-receiving country in Europe, yet hardly any English texts address Dutch refugee law. The book also covers foreign case law and academic writing. Therefore, the analysis is relevant for all refugee-receiving countries in the Western world; the empirical data on The Netherlands functions as a case study. The book combines perspectives of post-structuralist feminism and post-colonial studies. Refugee women are constructed as a double other. This intersectionality is related to the construction of the Third World as feminine (passive, in need of active outside intervention etc., etc.). The book provides a comprehensive overview of academic writing and of case law on the subject. On this basis of theoretical perspectives that were almost ignored until now, it develops an innovative critique of refugee law discourse and outlines its possible consequences for legal doctrine.

Refugees and Gender: Law and Process examines how those representing asylum seekers can ensure that all gender-related aspects of an asylum claim are considered and appropriately reflected in the determination process. The book aims to provide a comprehensive understanding of the concepts of gender-related persecution, as well as a gendered framework for the interpretation of the key elements of the 1951 Refugee Convention. Detailed information is provided on the implications of gender in asylum law, policy and practice in the UK, with comparative case-law and materials from other countries including Canada, US and Australia. Refugees and Gender: Law and Process provides a theoretical overview, an outline of case-law and a practical resource which is intended to improve standards of representation and decision-making, and to increase awareness of the gendered experiences of refugees facing persecution.

Extrait de l'introduction : "The survival strategies and resilience of refugee women are vital to substenance and social change in their households, workplaces and communities. As we write this introduction, Rwandese women and men and their families are becoming refugees in huge numbers, just as in the past, people from Vietnam, Cambodia, Laos, Bosnia, Sudan, Mozambique ..., have moved into exile. News reports tell of the devastating circumstances that often await refugees : makeshift camps devoid of water, food, health care and other basic human needs, in addition to threats to security. The forced displacement of millions of people across the world indicates that to remain safely in one's home community and country is no longer a fundamental human right. It is difficult to step back from devastating images of refugees to see these women as individuals ... And it is equally difficult to distance oneself by theoretical and abstract analysis. But feminist praxis must always be informed by theory, and theory by praixs. In this book we work toward change by examining the position of various groups of refugee women - in history and theory, cross-culturally and across disciplines and professions."

Debates over the headscarf and niqab, so-called ‘sharia-tribunals’, Female Genital Operations and forced marriages have raged in Europe and North America in recent years, raising the question – does accommodating Islam violate women’s rights? The book takes issue with the terms of this debate. It contrasts debates in France over the headscarf and in Canada over religious arbitration with the lived experience of a specific group of Muslim women: Somali refugee women. The challenges these women eloquently describe first-hand demonstrate that the fray over accommodating culture and religion neglects other needs and engenders a democratic deficit. In Refugee Women: Beyond Gender versus Culture, new theoretical perspectives recast both the story told and who tells the tale. By focusing on the politics underlying how these debates are framed and the experiences of women at the heart of these controversies, women are considered first and foremost as democratic agents rather than actors in the ‘culture versus gender’ script. Crucially, the institutions and processes created to address women’s needs are critically assessed from this perspective. Breaking from scholarship that focuses on whether the accommodation of culture and religion harms women, Bassel argues that this debate ignores the realities of the women at its heart. In these debates, Muslim women are constructed as silent victims. Bassel pleads compellingly for a consideration of women in all their complexity, as active participants in democratic life. The book will appeal to students and scholars throughout the social sciences, particularly of sociology, political science and women’s studies.

This book charts the roller coaster ride taken by the authors over the past 33 years, in the ongoing fight to acknowledge, prevent, and respond to the rape and sexual abuse of women in conflict and displacement situations. They have worked with an international network of academics, refugee women, and human rights activists in 22 countries. The story moves between refugee camps and the United Nations, refugee settlements in cities and national governments. Theory and ethical research methods are an important part of the story. At times it is very confronting, sometimes amusing and often uplifting.

The majority of the world's refugees are females and they represent the epitome of marginalization and disenfranchisement. This volume takes up the crucial issue of the gendered character of conflict-driven migration. The contributors highlight the importance of 'taking gender seriously' in migration research to improve both migration theory and conflict research. The volume provides critical insights into how to shore up women's rights in conflict and post-conflict situations by focusing on the way the experience of dislocation 'infantalises' and disempowers women in particular.
