The Criminalization series arose from an interdisciplinary investigation into criminalization, focussing on the principles that might guide decisions about what kinds of conduct should be criminalized, and the forms that criminalization should take. Developing a normative theory of criminalization, the series tackles the key questions at the heart of the issue: what principles and goals should guide legislators in deciding what to criminalize? How should criminal wrongs be classified and differentiated? How should law enforcement officials apply the law's specifications of offences? This, the fifth book in the series, offers a historical and conceptual account of the development of the modern criminal law in England and as it has spread to common law jurisdictions around the world. The book offers a historical perspective on the development of theories of criminalization. It shows how the emergence of theories of criminalization is inextricably linked to modern understandings of the criminal law as a conceptually distinct body of rules, and how this in turn has been shaped by the changing functions of criminal law as an instrument of government in the modern state. The book is structured in two main parts. The first traces the development of the modern law as a distinct, and conceptually distinct body of rules, looking in particular at ideas of jurisdiction, codification and responsibility. The second part then engages in detailed analysis of specific areas of criminal law, focusing on patterns of criminalization in relation to property, the person, and sexual conduct.

In the course of China's reform and opening up since the late 1970s, the country has made remarkable economic and social progress. China's jurisprudence, particularly in criminal law, has also seen significant transformation. Accordingly, the international legal community has shown considerable interest in the evolution of China's criminal law. I have authored numerous articles in English and German detailing the latest developments in Chinese criminal law, some of which have been translated into various languages, including Russian, Japanese, Korean, Spanish, Turkish, Ukrainian, and Georgian. Additionally, I contributed to the "Criminal Law in China" section in the "International Encyclopedia of Laws", a project compiled by Kluwer Law International in Europe. This section provides a systematic introduction to China's criminal justice system, but, due to the constraints of the encyclopedia's scope and editorial guidelines, it predominantly focuses on delineating the stipulations and the current state of Chinese criminal law. However, in the field of modern criminal law, the most fundamental aspect is the study of legal theory, especially the modes of thinking that it encompasses. Therefore, my aspiration has been to systematically summarize and clarify the contemporary state of Chinese criminal law theory, as well as to clearly describe the thought processes characteristic of China's modern criminal jurisprudence. This book, in its Chinese edition, aims to inspire and motivate the Chinese people to recognize their roles in the modern rule of law and to actively participate in the construction of China's socialist rule of law. It does so by explaining the comprehensive theory of modern criminal law in an accessible manner. The English version leverages this work to facilitate a deeper understanding of the latest developments in modern Chinese criminal law theory for English-speaking readers. In my view, such an endeavor holds significant value for fostering cultural exchanges in the context of our global pursuit to build a community with a shared future for all humanity.--Author.
