This book analyzes how the European Court of Human Rights (ECtHR) and the Inter-American Court of Human Rights (IACtHR) deal with general international law. In light of the concerns of various authors about the fragmentation of international law and the "human rightist" aspirations of human rights law, the question arises whether these human rights courts put the unity of general international law into danger. The main idea of this study is that the ECtHR and the IACtHR may, in principle, only "elaborate" and not "depart" from or "contradict" general international law. A departure is only acceptable if a clear lex specialis has been established for human rights law. Using state-of-the-art econometric tools, this book examines the implications of international fragmentation of production for the performance of the Japanese manufacturing industry.The impact of the ongoing process of international fragmentation of production and outsourcing has become a highly contentious issue in developed economies such as the US and Japan. Concerns about deindustrialisation and large-scale job losses - 'the export of jobs' have generated a political backlash against multinationals and globalisation. Using detailed data from Japanese multinationals this book rigorously analyses the Japanese experience and compares and contrasts it with the experience of US manufacturing. The study finds no empirical evidence that expansion of multinational activities in foreign countries produces job losses in the home country. Indeed, when demand induced indirectemployment effects are taken into account the increased profitability of Japanese firms is likely to have increased overall employment in Japan. However, the shift of labour intensive activities to low wage economies associated with the international fragmentation of production generates adjustment pressures and a structural shift in favour of skilled workers in Japanese manufacturing.

The paper uses a specific-factors framework to address efficiency and distributional implications of international fragmentation which is driven by a low foreign wage rate. Focusing on the cost-savings linkage between fragmentation and labor demand in the remaining domestic activities, the author establishes a fragmentation surplus. If capital is an indivisible asset specific to the fragment produced abroad, then fragmentation may cause a domestic welfare loss, because outsourcing takes place in discrete steps where it affords firms "quasi-market-power" on the domestic labor market. The regime shift from domestic production to fragmentation is modeled as a two-stage game. In stage one, firms locate indivisible assets at home or abroad; in stage two they choose optimal employment. The share of fragmented firms is endogenously determined. The paper explores conditions under which outsourcing is beneficial for the domestic economy.
