Doctoral Thesis / Dissertation from the year 2017 in the subject Law - Criminal process, Criminology, Law Enforcement, grade: A, , language: English, abstract: Close proximity to the major production zones, porous borderlands, mountainous frontiers and long coastlines offer advantageous conditions for trafficking narcotics. The illicit drug situation has become much more complex in Vietnam with the growth in amphetamine-type stimulants production and trade. Even so, empirical research and analysis of the organization and operation of transnational narcotics trafficking (TransNT) remains limited. The purpose of this thesis is to present the first detailed inquiry into the nature of TransNT across the border between Lao People’s Democratic Republic (PDR) and Vietnam using an exploratory approach which draws upon qualitative and quantitative methods. In particular, the thesis presents findings from case studies of cross-border trafficking between Vietnam and Lao PDR in the period of 2003-2013 combined with interview and survey data from criminal investigation police and drug-related crimes officers (CIPDRC) from six border provinces who are directly and indirectly involved in investigating these cases. The findings of this study indicate that drug markets in Vietnam are not controlled by monopolistic, hierarchical organizations or ‘cartels’. The structures of TransNT entities operating across the Lao-Vietnam border are small, based on family ties and fellow-countrymen relations, are fluid and loosely organized. They are very adaptable and sophisticated with diverse modus operandi and multiple divisions of labour. This presents particular challenges to law enforcement agencies (LAEs). This thesis questions to capacity of Vietnam’s police to enforce the government’s zero-tolerance anti-narcotics policy. The study highlights practical problems and specific barriers in combating TransNT. LEAs in Vietnam and Lao PDR operate without effective mechanisms to cooperate and share information. It is also the case that traffickers often have more sophisticated equipment at their disposal to help them avoid arrest. Police forces work within national structures and yet are faced with the task of combatting transnational crime. This reality affects law enforcement capacity at a national as well as regional level, but Association of the Southeast Asian Nations member states have yet to establish effective structures for dealing with this non-traditional security challenge. Based on these findings, therefore, the thesis proposes recommendations to enhancing the effectiveness of LEAs to combat TransNT between Vietnam and Lao PDR.

Especially their use as falsifying cases against the liberal notion of democratic peace theory is prominent - though questionable (Panke/Risse, 2007). Kant and his successors in the tradition of the liberal democratic peace theory can to a certain extent be defended even considering the recent wars - at east on the surface; these were fought between despotic states and democracies and therefore do not stand in opposition to the liberal peace theory in its 'narrow form'. Nevertheless, closer analysis reveals that the recent conflicts can be used as examples of severe violations of part of Kant's predictions and arguments. These arguments will be exposed within the first part of the essay formulated by Immanuel Kant already in 1795 (Kant, 2007). Afterwards the theoretical discussion will be expanded towards contemporary followers, such as Doyle (1983). They form what is often stated as the liberal democratic peace theory. Subsequently, the cases of Kosovo, Iraq and Afghanistan as possible points of falsifications against the trustworthiness of the theoretical arguments presented beforehand will be analysed.

Unprotected borders are a serious threat to the security of a number of states around the globe. The combination of weak states, ungoverned space, terrorism, and international criminal networks make a mockery of the Westphalian system of international order. Latin American countries are experiencing all of these maladies in varying degrees. The Andean region is under assault by a different kind of war that defies borders. In this context, Dr. Gabriel Marcella analyzes the lessons to be learned from the Colombian attack against the clandestine camp of the Revolutionary Armed Forces of Colombia, which was located at an isolated area within Ecuador on March 1, 2008. This single incident and its aftermath had profound reverberations throughout the Hemisphere. The events leading to the attack illuminate the vulnerabilities of states, societies, and the international community to the actions of substate groups ocnducting criminal activities. Accordingly, the hemispheric community of nations needs to develop better ways to anticipate and resolve conflicts. The United States plays a critical role in the emerging security environment of the Andean region. Yet a superpower is often unaware of hte immense influence it hasa with respect to small countries like Ecuador, which is trying to extricate itself from becoming a failed state. The author recommends that the United States manage its complex agenda with sensitivity and balance its support for Ecuador. This monograph is a valuable contribution to the strategy debate on how the United States can forge stronger cooperation and mutual support with Latin American partners.

Divided into four sections, this paper seeks to examine three main issues with regard to unconstitutional changes of government (UCG) in Africa. The first issue and section looks at the definition of the concept or phenomenon of UCG, at least from the viewpoint of the AU, with a special emphasis on the phenomenon of 'military coup d'état'. The second section deals with the policy position of the AU with regard to this phenomenon. This entails not only looking at the position of the AU, but also analysing the rationale behind it. In other words, knowing that the position of the AU is to condemn this phenomenon, the task is to interrogate this position to determine what led to its adoption and how justified it is. The third section then tries to scrutinise this position and examine its adequacy. In so doing, the preventive and reactive effect of the policy is juxtaposed with more emphasis on the latter. The fourth section deals in more detail with the preventive role of the policy and, with shortcomings identifi ed in this regard, highlights two important issues to be considered to enhance the preventive impact of the policy.
