The rapid development of new information and communication technologies has changed people’s everyday life and consumption patterns significantly. The worldwide spread of those technologies provides many innovations for consumers, but it can also bear risks, such as the indiscriminate collection, storage and cross-border flow of personal data, illegal spying on Internet activities, dissemination of personal information, and abuse of user passwords. The study deals with the current state of consumer data protection law in Brazil, China and Germany from a comparative perspective. It covers the main legal issues of consumer privacy and data protection in these countries and seeks to explain current issues and case law concerning consumer data protection from a practical perspective.

This book introduces data protection, i.e. the protection of individuals from misuse of their personal data. It provides a special focus on the direct impact on software development, e.g. in the form of functional requirements for software systems resulting from data protection. Chapter 1 provides an initial overview of the basic concepts of data protection and its legal foundations. Chapter 2 then delves deeper into the European General Data Protection Regulation (GDPR), covering in particular its basic concepts, terminology and requirements. Next, the specific implementation and interpretation of GDPR requirements in software and IT are dealt with, starting in chapter 3 with the principles of data protection defined in GDPR and the rights of data subjects in chapter 4. Chapter 5 discusses data transfer between organizations, including the relevant constellations (e.g. through various service providers), the legal framework and its practical implementation. Subsequently, chapter 6 changes the view from individual regulations and their implementation to technical and organizational design of data protection, including its embedding in the software life cycle, while chapter 7 provides an overview of information security and its aspects relevant to data protection. Eventually, chapter 8 deals with data protection for organizations as they are data subjects themselves. The appendices contain the most important excerpts from the Charter of Fundamental Rights of the EU and GDPR in this context, a collection of links to relevant laws and supervisory authorities, as well as a glossary of the most important terms used. The book’s target groups include software developers, IT consultants, requirements analysts, IT operations personnel and project managers in IT projects, but also data protection managers and data protection officers in the context of software development and IT.

This book offers a policy analysis of the emergence of the General Data Protection Regulation (GDPR) through the lens of John Kingdon’s Multiple Streams Framework. Drawing on 32 expert interviews with key stakeholders—including EU institution representatives (such as trilogue negotiators), member states, industry leaders, NGOs, and journalists—the author provides a deep dive into the decision-making process behind the regulation. Additionally, the study examines 462 position papers from the EU Commission’s consultation phases (2009–2011) to uncover the factors that shaped the adoption of the GDPR. At its core, this work explores the ‘window of opportunity’ that enabled the regulation's adoption.

General Data Protection Regulation: First Aid What do organisations that hold or process personal data need to know? From 25th May, 2018, the European Union’s General Data Protection Regulation, GDPR for short, applies. It creates a completely new basis for all data protection in the European Union. The fines for breaches have been drastically increased. In addition to large enterprises and other types of large scale organisation, small companies or free-lancers, small associations, clubs, societies and non-profit making organisations in many shapes and forms are entrusted with a lot of personal data - be it customer or client data, member data, employee data, or supplier data. Clubs and associations often have documentation that allows deep insights into the personal situation of their members. All organisations which hold or process this type of data are defined as "controllers" under the GDPR. It is therefore essential for the respective "controllers" to know the requirements of the GDPR. This publication informs you concisely and clearly regarding the content and the mandatory requirements relating to data processing in the GDPR. In particular it answers the following questions: - Which data is covered by data protection? - Is it necessary to nominate a Data Protection Officer? - Which obligations to provide information must be fulfilled proactively? - What information needs to be included in the records of data processing activities? - When is it permissible to forward data to other persons or organisations? - Which special requirements are there for photographs on your own website? Templates and check lists help you prepare and implement the legal requirements of the General Data Protection Regulation. Numerous examples demonstrate legal pitfalls and how to avoid them. This publication is aimed at owners of small companies, those responsible for data protection within small companies, chairpersons and members of clubs or associations and many other types of non-profit making organisation, as well as anyone else who wishes to gain a quick overview of the requirements of the data protection legislation. About the authors This publication was created by data protection experts. Dr. Eugen Ehmann is Vice-President of Central Franconia (Bavaria) and co-author of Ehmann/Selmayr, Kommentar zur DS-GVO (Commentary on the GDPR). Thomas Kranig is President of the Data Protection Authority of Bavaria for the Private Sector.
