Indonesia has probably the fastest changing legal system in the Muslim world. This ethnographic account of legal pluralism in the post-conflict and disaster situation in Aceh addresses changes in both the national legal system and the regional legal structure in the province. Focusing on the encounter between diverse patterns of legal reasoning advocated by multiple actors and by different institutions (local, national and international; official and unofficial; judicial, political and social cultural) it considers the vast array of issues arising in the wake of the December 2004 earthquake and tsunami in Aceh.It investigates disputes about rights to land and other forms of property, power relations, the conflict of rules, gender relationships, the right to make decisions, and prevailing norms. These disputes are presented on multiple levels and in various forums, either through negotiation or adjudication, regardless of whether they are settled or not. The cases involve various actors from villages, the courts, the provincial government and the legislature, the national Supreme Court and the central government of Indonesia.

This research aims to examine the primary legal cases and examples showing the juristic divergences between Nahdlatul Ulama and Persatuan Islam in the sphere of jurisprudence of worship and Islamic legal transactions while exploring some of the legal debates between these two organizations in the political arena. As such, the legal methods underlying the juristic reasoning adopted by both are discussed. The methodology applied in this study is based on analytical approach, involving the explanation, detail of selected legal verdicts and their evidence in order to show the influences on the socio-political context in Indonesia. This study also applies the inductive approach to observe the legal theories and methodologies while exploring convergences and divergences between both. The study has identified that Nahdlatul Ulama bases its juristic interpretation on the legal theory drawn from the Shāfi'ī School of law. It seems that the NU considers madhhab because it provides a reliable and systematic framework and as such Muslims should adhere to the rulings of a madhhab. On the other hand, PERSIS considers madhhab as one influential source in legal rulings while holding that the Qur'ān and the Sunnah are the fundamental truths for Muslims. As such PERSIS encourages Muslims to avoid taqlīd.

This book seeks to open new lines of discussion about how Islamic law is viewed as a potential tool for programs of social transformation in contemporary Muslim society. It does this through a critical examination of the workings of the state shari'a system as it was designed and implemented at the turn of the twenty-first century in Aceh, Indonesia. While the empirical details of these discussions are unique, this particular case presents a remarkable site for investigating the broader issue of the impact of instrumentalist, future-oriented visions of Islamic law on modern Muslim calls for the state implementation of Islamic law. In post-tsunami/post-conflict Aceh, the idea of shari'a as an exercise in social engineering was amplified through resonance with an increasingly pervasive rhetoric of 'total reconstruction'. Based upon extensive fieldwork as well as critical readings of a wide range of archival materials, official documents, and local publications this work focuses on the institutions and actors involved with this contemporary project for the state implementation of Islamic law. The individual chapters are structured to deal with the major components of this system to critically examine how these institutions have taken shape and how they work. It also shows how the overall system was informed not only by aspects of late twentieth-century da'wa discourses of Islamic reform, but also modern trends in sociological jurisprudence and the impact of global models of disaster relief, reconstruction, and development. All of these streams of influence have contributed significantly to shaping the ways in which the architects and agents of the state shari'a system have attempted to use Islamic legislation and legal institutions as tools to steer society in particular desired directions.
