The temporary movement of labor is one mode of delivering services across borders. Unlike the movement of capital, and despite significant returns to mobility, labor movement remains highly restricted and politically sensitive. To circumvent this problem, the use of bilateral labor agreements (BLAs) may serve as a potential complementary means of increasing temporary labor mobility, particularly among workers in the services sector. BLAs are generally not part of trade agreements, nor are they designed to promote services exports by the sending country, although they could be used to do so.Let Workers Move: Using Bilateral Labor Agreements to Increase Trade in Services assesses what has been achieved so far in trade agreements in terms of the temporary movement of services providers and explores how BLAs might allow countries--especially developing countries--to focus on the temporary movement of very specific categories of workers, such as computer programmers or electricians within the construction sector. It also reviews case studies from Europe, North America, the Caribbean, and the Pacific to examine the viability and performance of BLAs as a complement to other efforts to liberalize the temporary movement of people.This book will be useful to policymakers interested in expanding opportunities for services trade, academics in developing countries interested in trade as a development tool, and experts involved in trade negotiations. "For employees, collective protection has never been more urgent. Everywhere, pressures resulting from worldwide competition and technical innovation are downgrading and relocating jobs, closing companies, and fuelling workers' fears of less-than-secure working conditions, de-qualification, and job loss. However, in order to establish the necessary preconditions for any transnational solidarity, it is necessary to define and clarify both what is distinctive and what is fundamental in the different legal frameworks affecting trade union activity. That is what this book sets out to do. The essays presented here are an outcome of an international and comparative conference, organised and sponsored by the newly established Hugo Sinzheimer Institute of Labour Law (HSI), Frankfurt am Main, which took place in Frankfurt in January 2011 at the premises of IG Metall, the world's largest trade union. The book offers an overview of trade union rights in each of seven industrial countries: Belgium, Hungary, England, Germany, France, the Netherlands and the United States. A concluding chapter by Manfred Weiss notes the futility of a 'harmonization' approach, stressing rather a strategy of accepting variety which nevertheless embraces close cooperation. Issues covered include the following: direct and indirect recognition of the rights of the unions at the workplace; the right of access of trade union representatives not employed in the establishment; competition from non-unionized firms and low labour cost operations; new styles of management hostile to trade unions; employers' use of the courts to prevent industrial action illegalized by new legislation; relations among trade unions, works councils, workers' representatives, and employers' organizations; the role of the union at a time of change of company ownership; and effects of public resistance to cuts in public services and to job losses. Originally published in 1984, this book provides the first full account of the lives and aspirations of those who have worked in Britain to deliver mail, convey telegrams and transmit telephone conversations from the beginnings of such activities to the middle of the 20th century. Exploring the contentious relationship between trade and labour, this book looks at the impact of the EU’s ‘new generation’ free trade agreements on workers. Drawing upon extensive original research, including over 200 interviews with key actors across the EU and its trading partners, it considers the effectiveness of the trade-labour linkage in an era of global value chains. The EU believes trade can work for all, claiming that labour provisions in its free trade agreements ensure that economic growth and high labour standards go hand-in-hand. Yet whether these actually make a difference to workers is strongly contested. This book explains why labour provisions have been profoundly limited in the EU’s agreements with the CARIFORUM group, South Korea and Moldova. It also shows how the provisions were mismatched with the most pressing workplace concerns in the key export industries of sugar, automobiles and clothing, and how these concerns were exacerbated by the agreements’ commercial provisions. This pioneering approach to studying the trade-labour linkage provides insights into key debates on the role of civil society in trade governance, the relationship between public and private labour regulation, and the progressive possibilities for trade policy in the twenty-first century.
